Quantum Kiwi (“Quantum Kiwi,” “we,” “us,” or “our”) operates the website at quantumkiwi.net (the “Site”) and curates a small catalog of outdoor and everyday-carry gear sold under the Quantum Kiwi brand.

By accessing the Site, browsing the catalog, creating an account, or placing an order, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Site.

You must be at least 18 years old, or the age of legal majority where you live, to place an order. By ordering, you represent that you meet this requirement and that the billing and shipping information you provide is accurate, current, and your own.

If you create an account, you are responsible for keeping your credentials confidential and for all activity that occurs under your account.

Listings on the Site are an invitation to order, not an offer. When you place an order you make an offer to buy the item on these Terms. The contract of sale is formed only when we send a confirmation that your order has been accepted and dispatched for fulfillment.

We reserve the right, at our sole discretion, to:

• refuse, limit, or cancel any order for any lawful reason;
• limit quantities purchased per person, per household, or per order;
• correct pricing, description, or stock errors at any time, even after an order has been submitted;
• require additional verification before accepting or shipping an order.

If we cancel an order after payment, we will refund the amount charged to the original payment method.

All prices are shown in U.S. Dollars (USD) unless otherwise indicated, and are exclusive of shipping, duties, and taxes unless stated. Prices may change at any time and promotions may end without notice. The price applicable to your order is the one displayed at the time we accept it.

For shipments outside the United States, you are the importer of record and are responsible for any customs duties, import VAT, or local taxes assessed by the destination country. These charges are not collected by Quantum Kiwi and are not included in the price or shipping fee shown at checkout.

We try hard to keep prices and stock accurate. If a product is listed at an obviously incorrect price (for example, a typographical error), we may cancel the order and refund any amount paid, even after order confirmation.

Payments on the Site are processed by Stripe, Inc. We do not store your full card number on our servers. By submitting payment details you authorize us (and Stripe) to charge the total order amount, including shipping and any applicable taxes, to the payment method you provide.

You are responsible for any fees your bank or card issuer may charge, including foreign transaction or currency-conversion fees. If a payment is reversed, charged back, or otherwise fails after we have shipped, you remain liable for the full order amount and any recovery costs.

Important — please read. Quantum Kiwi operates a curated catalog and works with third-party manufacturing and fulfillment partners — including, but not limited to, CJ Dropshipping, Zendrop, and similar global suppliers — to produce, warehouse, and ship products. This means:

• Most items ship directly from one of our supplier’s warehouses, which may be located outside your country (often in Asia).
• Different items in the same order may ship separately, from different warehouses, in different parcels, with different tracking numbers, and may arrive on different days.
• Packaging is generic; products do not always arrive in Quantum-Kiwi-branded boxes.
• Once an order has been transmitted to a supplier (typically within a few hours of payment) it cannot be modified or cancelled.

We pass shipping addresses, contact details, and order contents to our fulfillment partners only as needed to ship your order. See our Privacy Policy for details.

Estimated processing time is generally 1–5 business days. Estimated delivery time after dispatch is generally 7–20 business days for international shipments and 3–10 business days for domestic shipments, depending on destination, carrier, and customs. These windows are estimates only and are not guaranteed.

Delivery dates may be affected by carrier delays, customs inspection, weather, public holidays, supplier stock, or other circumstances outside our reasonable control. Quantum Kiwi is not liable for delays caused by such circumstances, and delays alone do not entitle you to a refund.

Risk of loss and title for items pass to you upon delivery to the carrier. You are responsible for entering an accurate, complete shipping address; orders returned to sender because of an incorrect or incomplete address may be refunded less original shipping and any return-shipping costs charged by the carrier or supplier.

Cancellations

Orders may be cancelled for a full refund only if the cancellation request is received and acknowledged by us before the order has been transmitted to our fulfillment partner. After that point the order cannot be cancelled.

Damaged, defective, or wrong items

If an item arrives damaged, defective, or materially different from what was ordered, contact us at [email protected] within 14 days of delivery with your order number and clear photos showing the issue and the shipping label. We will arrange a replacement, store credit, or refund at our discretion.

Change-of-mind returns

Because items ship from third-party warehouses worldwide, return shipping for change-of-mind returns is not economical and is not offered by default. Where a change-of-mind return is approved in writing by us, you are responsible for return shipping and the original outbound shipping fee is non-refundable. Items must be returned unused, in original packaging, and reach the address we provide within 14 days of approval.

Lost packages

If tracking shows no movement for 30 consecutive days after dispatch, contact us and we will open a trace with the carrier and, if the package is confirmed lost, arrange a reshipment or refund.

Non-returnable items

• Items marked “Final Sale” on the product page;
• Items damaged through misuse, accident, or normal wear;
• Items returned without prior written authorization from Quantum Kiwi.

Approved refunds are issued to the original payment method and typically appear within 5–10 business days of processing, depending on your bank.

We work hard to describe products accurately. However, colors, sizes, packaging, accessories, and minor design details may vary between production batches and between suppliers. Photographs are illustrative; the item you receive may differ slightly in finish, labeling, or packaging from the images shown.

Specifications, materials, and feature lists are provided by our suppliers and are believed to be accurate at the time of listing, but are not warranted to be error-free. If a specification is critical to your purchase decision, please contact us before ordering.

To the fullest extent permitted by law, the Site and all products are provided “as is” and “as available,” without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Quantum Kiwi does not manufacture the products it sells and makes no independent warranty regarding their performance, durability, or suitability for any specific use. Where a manufacturer’s warranty is provided, your remedy is governed by that warranty.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the exclusions above apply only to the extent permitted by law, and you may have additional statutory rights that these Terms do not affect.

To the maximum extent permitted by law, in no event shall Quantum Kiwi, its owners, employees, suppliers, or fulfillment partners be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Site, any product purchased through the Site, or any delay or failure in delivery — whether based in contract, tort (including negligence), strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or any product purchased through the Site shall not exceed the amount you actually paid to Quantum Kiwi for the product giving rise to the claim.

You agree to defend, indemnify, and hold harmless Quantum Kiwi and its owners, employees, agents, suppliers, and fulfillment partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the Site; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party; or (d) any misuse of products you purchase through the Site.

The Site, the Quantum Kiwi name and logo, the editorial copy, photography, layout, and code are owned by Quantum Kiwi or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, republish, scrape, or create derivative works from any part of the Site for commercial purposes without our prior written consent.

Product photographs and specifications supplied to us by manufacturers or fulfillment partners remain the property of their respective owners and are used under license.

You agree not to:

• use the Site for any unlawful, fraudulent, or harmful purpose;
• attempt to gain unauthorized access to any part of the Site, our systems, or other users’ accounts;
• interfere with or disrupt the Site, including by introducing malware, scraping at abusive rates, or running automated traffic against checkout;
• place orders using a stolen card, false identity, or with the intent to commit chargeback fraud;
• resell products purchased from Quantum Kiwi for commercial purposes without our prior written consent.

The Site relies on third-party services to operate, including (but not limited to) Stripe for payment processing, Cloudflare for hosting and content delivery, WooCommerce for order management, and fulfillment partners such as CJ Dropshipping and Zendrop. Your use of those services through the Site is also subject to their own terms and policies. We are not responsible for the acts or omissions of third-party providers beyond what is required by applicable law.

Your use of the Site is also governed by our Privacy Policy, which explains what information we collect, how we use it, and with which third parties (including payment processors and fulfillment partners) we share it. By using the Site you consent to that processing.

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects when changes take effect. Material changes will be posted on this page; your continued use of the Site after a change constitutes acceptance of the updated Terms. The version of the Terms in effect at the moment you place an order governs that order.

These Terms and any dispute arising out of or relating to them or to your use of the Site are governed by the laws of the United States and the State in which Quantum Kiwi is established, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

You and Quantum Kiwi agree to first attempt to resolve any dispute informally by contacting us at [email protected]. If a dispute cannot be resolved within 30 days, it shall be submitted to binding individual arbitration, and not to a class action, to the extent permitted by applicable law. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
